WTO Trade Facilitation Agreement & Kenya's Implementation
The WTO Trade Facilitation Agreement (TFA) entered into force on 22 February 2017. It is the first multilateral WTO agreement concluded since the WTO's establishment in 1995 and binds all 164 WTO members including Kenya. The TFA defines the customs-modernisation baseline; Kenya's iCMS, KenTrade Single Window, AEO programme and pre-arrival processing all derive from TFA commitments.

Article 10 — Formalities and Documentation
- 10.1 — Minimise formalities; review periodically

- 10.3 — WCO Data Model, Kyoto Convention international standards
- 10.4 — Single Window — KenTrade (Kenya National Electronic Single Window System / TradeNet) operational since 2014. Covers KRA, KEBS, KEPHIS, KMA, AFA, PCPB, ACA, KPA and 30+ agencies. https://www.kentrade.go.ke
- 10.5 — Members shall not require PSI for tariff classification or valuation. Does not prohibit PSI for conformity (which is what KEBS PVoC does)
- 10.6 — No mandate for use of customs brokers
- 10.7 — Common border procedures

- 10.9 — Temporary admission, inward and outward processing
Article 12 — Customs Cooperation
Information exchange between customs administrations subject to confidentiality. Kenya operates this through the EAC Customs Mutual Administrative Assistance protocols and the WCO RILO ESA (Regional Intelligence Liaison Office for Eastern and Southern Africa) hosted in Mombasa.

Kenya deposited TFA notifications with the WTO Trade Facilitation Committee:
- Category A (immediate): WT/PCTF/N/KEN/1, dated 22 July 2014. 14 measures
- Category B (transitional): G/TFA/N/KEN/1, dated 16 January 2018, definitive implementation 2018–2022
- Category C (capacity-dependent): G/TFA/N/KEN/2, dated 16 January 2018, implementation 2020–2026
Operational Status (2026)
- Single Window: full integration with iCMS achieved 2019
- Risk Management: iCMS RME live since 2019
- Pre-arrival processing: operational since 2018 EACCMA reform
- AEO: 80+ certified
- Time Release Study: latest 2023
What This Means for Sarpah Cargoes
- Pre-arrival lodgement is the operating standard. IDF, KEBS CoC, KEPHIS permit, AFA permit (only for AFA-scheduled crops — cereals, sugar, coffee, tea, horticulture, fibre, nuts and oils, miraa, pyrethrum; not fertilizer) and KRA Bill of Entry submitted before vessel arrival
- Risk-channel routing through iCMS is anticipated and managed; AEO-status counterparties experience Green-lane releases as standard
- Single-Window submission through KenTrade — single electronic submission triggers KRA, KEBS, KEPHIS, AFA (for AFA-scheduled crops — cereals, sugar, coffee, tea, horticulture, fibre, nuts and oils, miraa, pyrethrum; not fertilizer) processing in parallel
- Electronic payment of all duties, taxes and fees through KEPSS or direct debit to KRA accounts
- Post-clearance documentation retained for KRA PCA cycle (typically 5 years)
